VIRGINIA BEACH, Va. (WAVY) - A man is now facing an additional charge of capital murder in connection with an officer's death, according to the Commonwealth's Attorney.
Raymond Lewis Perry was indicted in court Monday on charges of first degree murder, robbery, two counts of use of firearm, along with the newest charge of capital murder, in connection with Norfolk Police Officer Victor Decker's death in October 2010.
Perry's fellow inmates testified last month that Perry had confessed to killing Decker during an apparent robbery.
Five witnesses testified in court, including one detective, three current fellow inmates and one former fellow inmate.
"It's a stick up. He refused and he shot the guy," one inmate testified.
A witness, who also testified, said Perry and another man were out to rob someone that October 2010 evening and settled on Decker, not knowing he was a police officer. The witness said the second man hesitated and Perry allegedly shot Decker and took his wallet.
A similar story was told by another one of Perry's fellow inmates in court.
Two other witnesses, also currently imprisoned, said they saw Perry in the area.
However, Perry told WAVY.com in a jailhouse interview in August 2012 he was innocent and that he would take a polygraph test to prove himself.
"I'm innocent. I'm not guilty. I don't even know Officer Victor Decker," Perry said.

He claims "jailhouse informants" trying to get their sentences cut snitched on him and that's what led police to arrest him for the crime.
Perry was arraigned on charges of first-degree murder, armed robbery and two counts of use of a firearm in August 2012.
Police told WAVY.com Perry was serving an 88-year sentence in South Carolina for a series of robberies when he was charged with Officer Decker's murder. Perry was extradited to Virginia Beach in August when he became a suspect in Decker's death.
Decker, 25, was shot and killed in October 2010. Police say his body ways found next to his truck off the side of the road. Decker was off duty at the time.
Investigators say they conducted more than 200 interviews in this case.
