VIRGINIA BEACH, Va. (WAVY) - Attorney General Ken Cuccinelli has ordered felons can not be ordered to serve jail terms on weekends or nonconsecutive days.
In a letter addressed to the Commonwealth's Attorney's Office , Cuccinelli says the language implies only those charged with a "misdemeanor or traffic offense" can serve weekend sentences to "retain gainful employment."
The language of the statute reading "[a]ny court having jurisdiction for the trial of a person charged with a
criminal offense or traffic offense" was changed in 1999 to "misdemeanor or traffic offense." Cuccinelli says this change was made to "clearly intended to limit applicability of the statute."
