PORTSMOUTH, Va. (WAVY) - VDOT has asked plaintiffs suing it and the Elizabeth River Crossing to provide in detail how installing tolls on the Downtown Tunnel will encroach on their Constitutional rights.
The motion for a bill of particulars was filed in court Aug. 3 by VDOT's lawyer E. Duncan Getchell, asking the plaintiffs to "amplify the complaint as to the parties involved and the specific conduct alleged against VDOT."
A group of citizens represented by Patrick McSweeney filed the lawsuit last month , alleging tolls imposed on the tunnel by unelected officials and a private company is illegal.
"Here we [have] a private entity and VDOT, [both] unelected [entities] reaching an agreement that in effect sets taxes, not just tolls," McSweeney told WAVY.com in July.
