CHESAPEAKE, Va. (WAVY) - The family of a crossing guard struck and killed while on the job one year ago has said they are ready to accept a $100,000 settlement.
Lovette Person of Virginia Beach, 35 at the time of the accident, was struck and killed while working at the intersection of Brittany Way and Terry Drive in Chesapeake Oct. 3, 2011.She had only been on the job for about 18 months.
Tiare Blees, 32 at the time of the accident, was convicted of an improper driving charge in April and was fined $250. Prior to the incident, Blees had a perfect driving record. Police say she may have been distracted by the sun while driving.
Person's family had originally sued Blees for $6 million, but the family lawyer, Stephen Swain, told WAVY.com Thursday they are now willing to settle for $100,000, the full insurance amount.
A Chesapeake Circuit Court judge will review the agreement following Person's son's 18th birthday Oct. 14.
