Murder suspect's charges nolle prosequi

NORFOLK, Va. (WAVY) - A man previously arrested on charges he brutally murdered a beloved barber shop owner in 2010 is exonerated after his charges were nolle prosequi Friday.

Dahson Danata Iraldo, 29, was charged in the death of Henry B. McIntosh, owner of Square Deal Barber Shop located in the 1600 block of Church Street. McIntosh was gunned down inside the business on April 17, 2010 in what police called a robbery gone bad.

McIntosh's family had been looking for closure for months.

"A day goes by, a week goes by and a month goes by, but today is the day that we can rejoice," McIntosh's daughter Pam Livingston told WAVY.com the day Iraldo was arrested.

During a jailhouse interview with WAVY.com in July, Iraldo maintained his innocence.

"I'm being falsely accused of something I didn't do," Iraldo said. "I don't want my life taking away for something I didn't do."

Iraldo had been charged with murder, robbery and two counts of use of a firearm in the commission of a felony in connection to McIntosh's murder

The charges against Iraldo were nolle prosequi during a hearing Friday morning because of insufficient evidence, which means the Commonwealth Attorney's Office will not seek prosecution.

"I'm semi disappointed because its a bittersweet situation," Virgil DeLoatch, one of the victim's daughters told WAVY.com after the hearing.

Amanda Howie with the Norfolk Commonwealth's Attorney's Office told WAVY.com Iraldo is still in custody for a charge of possession of a firearm by a convicted felon in connection to an incident on July 17, 2012. The offense is not related to the murder of McIntosh. Howie said he is scheduled for a jury trial on Nov. 13.

If convicted, Iraldo will spend a mandatory five years behind bars.
